This is a translation. The French version prevails in case of difference.
1. Purpose
These terms govern your use of the Sweetin app, which lets you send friends a photo hiding a secret message that the recipient reveals by scratching the photo with a finger. By creating an account, you accept these terms and the privacy policy.
2. Publisher and hosting
- Publisher: [Company name], [legal form] with a share capital of €[amount], [registered office], RCS [city] [SIREN], VAT [number].
- Publication director: [name, title].
- Contact: team@sweetin.app.
- App data hosting: Supabase, Inc., 3500 S. DuPont Highway, Dover, DE 19901, USA (legal@supabase.io), servers located in the European Union.
- Website hosting: [name, address and phone of the website host].
3. Access
- Sweetin is for people aged 16 or over. By signing up, you confirm you are that age and give your real date of birth.
- Accounts are personal. You are responsible for keeping your credentials confidential and for what is sent from your account.
- The service is free. It requires an internet connection, at your own cost.
4. The service
- A sweet (a photo and a secret message) is only sent to the recipients you choose: friends, a private link (openable once, even without the app) or a “scratch my secret” story link (openable by anyone with the link for 24 hours). It is erased from our servers as soon as every recipient has scratched it, and at the latest 7 days after sending (24 hours for a story).
- Anyone you give a link to can open it. Only share a story link where you’re happy for anyone to see the sweet.
- Streaks count the consecutive days you and a friend exchange sweets.
- The “one swipe” option limits reading to a single finger gesture.
- Sweet Hour is a daily moment, at a surprise time, when every user is invited to send a sweet.
- Important limit: screenshots are blocked on Android and reported to the sender on iOS, but nothing can stop a recipient from photographing the screen with another device. Sweetin does not guarantee that content you send will never be kept by its recipient.
- We keep improving the app and may change, suspend or discontinue a feature. We strive to keep the service available but cannot guarantee it.
5. Rules of conduct
You may not send, by photo or message:
- any sexual content involving a minor, or any solicitation of a minor. Such content is always reported to the authorities;
- nudity or sexual content;
- threats, harassment, bullying, hateful or discriminatory content;
- violent or shocking content, or content encouraging suicide, self-harm or eating disorders;
- a photo of someone without their consent, or private information about someone;
- illegal or fraudulent content, or content infringing others’ rights (copyright, image rights, trademarks);
- advertising, spam or automated sending.
You may not impersonate anyone, create accounts to get around a sanction, or try to disrupt, reverse-engineer or misuse the service.
6. Moderation, reporting and appeals
- Before sending, every sweet is checked automatically. A sweet that appears to break the rules above is not sent and its photo is erased.
- Report: from a received sweet, tap “•••” then “Report and block”. The person is blocked immediately and a copy of the message is kept for review. Anyone, even without an account, can also report illegal content to team@sweetin.app, stating the username, the nature of the problem and their contact details.
- Handling: we review reports diligently, within 24 hours for the most serious content. We may remove content, restrict an account, suspend it or close it permanently, depending on the severity and repetition.
- Notice and appeal: we tell the person concerned about the decision and its reasons, unless the law prevents it. They can challenge it for 6 months by writing to team@sweetin.app; the appeal is reviewed by a person. They may also use a certified out-of-court dispute settlement body or go to court.
- Single point of contact for authorities and users (EU Digital Services Act): team@sweetin.app, in French or English.
7. Your content
You keep ownership of the photos and messages you send. You only allow us to store them, analyse them for moderation and deliver them to the recipients you chose, for as long as needed to deliver them. You guarantee you hold the necessary rights, including the consent of people visible in your photos.
8. Intellectual property
The app, its name, logo, design and code belong to the publisher. You receive a personal, non-exclusive, non-transferable right to use the app for as long as you have an account.
9. Liability
For content sent by users, Sweetin acts as a hosting provider: each user is responsible for what they send. We act promptly to remove manifestly illegal content once we are aware of it. We are not liable for temporary unavailability of the service, loss of a sweet not yet scratched, or use of the service contrary to these terms.
10. Ending use
- You can delete your account at any time in the app (your profile photo at the top of the home screen → Settings → Delete my account) or by following these instructions.
- We may suspend or close an account that breaks these terms, following the procedure in section 6, or the account of a person under 16.
11. App downloaded from the App Store
If you downloaded Sweetin from the App Store: these terms are between you and the publisher, not Apple Inc.; Apple has no obligation to provide maintenance or support for the app; any claim about the app (compliance, intellectual property, liability) must be addressed to the publisher; Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You represent that you are not located in a country subject to a US embargo and are not on any US government list of restricted parties.
12. Changes
We may change these terms. For any significant change, you will be notified in the app at least 15 days before it takes effect. If you disagree, you can delete your account.
13. Governing law and disputes
These terms are governed by French law. In case of a dispute, please write to team@sweetin.app first so we can find an amicable solution. Consumers may use the consumer mediator [mediator name and website] free of charge. Failing agreement, the courts designated by law have jurisdiction; for consumers, this includes the courts of their place of residence.
